Defamation Suit Against Kerik Lawyer and Daily News Dismissed

Attorney Joseph Tacopina's defamation lawsuit against Bernard Kerik's lawyer and a New York City newspaper has been dismissed by a federal judge.
Southern District Judge Paul Crotty said that the fair reporting privilege protected allegedly defamatory statements that Kerik attorney Timothy Parlatore made to the New York Daily News in 2014, and he dismissed claims against the newspaper for two articles published in October 2014.
The case was part of a long-running brawl between Kerik, the former New York City police commissioner and one-time nominee for Department of Homeland Security chief, and Tacopina, of Tacopina & Seigel, who represented Kerik on criminal charges in the Bronx nine years ago.
Kerik had filed an ethics complaint against Tacopina in 2013 and sued Tacopina the following year alleging a series of improper acts, including breach of fiduciary duty of an attorney toward a client.
Kerik claimed Tacopina led him to believe that, if he pleaded guilty to two state misdemeanors in 2006 in Bronx Supreme Court, he would not face further prosecution. But federal prosecutors proceeded with a separate investigation of Kerik, who was ultimately convicted of tax evasion in New Jersey federal court in 2009 and served three years in prison.
Kerik's lawsuit against Tacopina was dismissed by Southern District Judge John Koeltl in December (NYLJ, Dec. 4, 2014).
On Oct. 15, 2014, Parlatore filed suit against Tacopina in state court on behalf of a Jane Doe, a former Tacopina client who claimed Tacopina had committed malpractice in an unrelated civil action. The woman alleged Tacopina urged her to accept a low-ball settlement with an unnamed law firm where she once worked as an associate while failing to disclose he was of counsel at the firm.
Parlatore submitted an affidavit in the Doe case claiming Tacopina had come under "public scrutiny for his considerable unethical and dubious practices" including that he was "abusing" cocaine.
That same day, Oct. 15, the Daily News ran an article headlined "Lawsuit against Joe Tacopina seeks to freeze lawyer's assets as he closes deal to buy Italian soccer club Bologna."
The article reported that the complaint filed by Kerik had alleged Tacopina "abused painkillers and cocaine during his failed" defense of a woman convicted of murdering her husband, when, in fact, Kerik's complaint only mentioned "prescription pain medications."
Two days later, on Oct. 17, the Daily News ran another article saying "Judge orders celebrity attorney Joe Tacopina—now boss of second-division soccer team in Italy—to court," in the Doe case when in fact Tacopina's appearance was optional.
The article stated the judge required Tacopina to explain why he shouldn't be barred from selling assets until his legal dispute with Doe was resolved.
Tacopina's lawsuit, filed Oct. 20, named Parlatore for the Jane Doe affirmation and the Oct. 15 article, and it named the Daily News and reporter Michael O'Keeffe for the Oct. 15 and 17 articles. He said Parlatore and the newspaper gave the impression he was fleeing the United States to avoid creditors and he had abused drugs.

In dismissing the case Friday, Crotty cited New York Civil Rights Law §74, which bars civil actions based on "the publication of a fair and true report of any judicial proceeding."
"In certain circumstances, publication of legal documents that have not yet been filed may be protected by the fair reporting privilege," he said inTacopina v. O'Keeffe, 14 Civ. 8379. "New York courts have held that statements to the press regarding the litigation position a party intends to take are protected by New York Civil Rights Law §74, even where the documents containing the position have not yet been filed, so long as the party ultimately takes that position in the litigation."
Here, he said, there was no indication that the affirmation Parlatore gave O'Keeffe "was in any way different" from the one he ultimately filed in court.
"Nor is there any allegation that the Daily News reported on the Jane Doe affirmation before it was filed," he said. "In these circumstances, Parlatore's alleged conduct does not vitiate the fair reporting privilege."
Over Tacopina's argument to the contrary, the judge said the mistaken attribution to the Kerik complaint in the Oct. 15 article didn't matter because the result was the same.
"The court agrees," Crotty said. "Whether the allegation regarding cocaine appeared in the Kerik complaint or the Jane affirmation, nonetheless it was made in a publicly filed document."
The judge continued: "Moreover, reporting that allegations regarding prescription pain medication and cocaine were made in a single lawsuit by one former client does not 'suggest more serious conduct' than what actually occurred: those allegations came from two different lawsuits by two former clients."
Crotty went on to find that neither the Oct. 15 nor the Oct. 17 articles were defamatory.
Parlatore had moved against Tacopina and his attorney, for sanctions for bringing a frivolous lawsuit, but the judge declined.
"The lawsuit was not frivolous," Crotty said. "While the amended complaint is dismissed, it is not so lacking in merit as to warrant the imposition of sanctions."
Judd Burstein represented Tacopina. Burstein said he would appeal the decision. "I think the opinion makes it clear there was sort of a hit job on Tacopina," he said.
Matthew Leish assistant general counsel at the Daily News, represented the newspaper and O'Keeffe.
Parlatore represented himself.
"The Jane Doe case is still active; ­the restraining order [on assets] is still in place," said Parlatore, who said Tacopina "had filed counterclaims against her [Doe] based on the same ridiculous claims he made against me in this case."
As for the defamation claims, "I'm glad that the judge saw through it," Parlatore said.

Geraldo Rivera on WABC New York Radio Today.......

Geraldo, like just about every one else in this country is infuriated by the ease in which mentally ill individuals can obtain guns.

He said I have constitutional right and my children and my family members to be free from the weaponed anger of the mentally ill.

Why are we defending their rights to obtain a firearm?

Geraldo Rivera said on more than one occasion today......The Second Amendment is Stupid.

Yesterday he also said this gun law is outdated and written in a time when we were originally defending our country against Britain.

Times have changed and the law and the meaning for it is antiquated.

Geraldo went on to say today the NRA does not really disclose all of the information--they do not want the American people to know the statistics.

The Ronnie Republic asks the question......well, how does is actually work in Europe where there are not guns .........are the citizens happy about not having easy access to firearms or are they angry.

How does it work for the police.....how does it work for the criminals.

Are different gun laws reasonable for the United States......how are we different from Europe.

Often watching Piers Morgan and his frequent rant against the US gun laws and comparing our stats to those of the UK..........the guests he had on his show act as if the UK is another planet when he brings up the facts.

What about Japan.......how to gun laws work there.....can we implement some of these ideas in the US.

What is realistic for our wonderful but suffering country.

What do the police chiefs think.

What does Bernie Kerik think?

Lets continue this discussion and keep talking about it until we can get to a reasonable solution.....part of a solution.

Talking about the recent tragedy in Santa Barbara where so many young adults lost their lives due to the anger of a mentally ill individual.

Let's just keep talking right now until we can find a solution.

Indeed, Geraldo Rivera is a breath of fresh air for he Republican Party--he is not your basic angry, old, white, NRA preaching, GOP member.

He sad today........I'm not afraid to talk....what are they going to do to me.

Good for you, Geraldo, for speaking out against the NRA and the repubs--they certainly are not on the road to winning an big election in their current state--after all, it would be nice to have at least two parties.

The Ronnie Republic Radio Round-Up with Rita Cosby

Have to say it.....Rita is good.......


Filling in for Geraldo Rivera this week on WABC New York.

Last week was very trying.....we had an angry man with wrong information.....that's never good is it.


Well, I guess WABC finally came to its senses and got some one in the same grain as their regular radio Rastafarian, Geraldo Rivera.

Rita Cosby, beautiful lady with a beautiful voice, talks to the callers, invites their opinions and, most importantly, does not freak out when they say something with an idea different from hers.

People, we have got to promote the political conversation--no one group or individual is ever all right or all wrong--even republicans.

Of course, Geraldo is the king of this radio magic....all of the big talkers call in and love to tell Geraldo everything on their mind....and all the New York neighbors call in, too.....as if they have been buddies with Geraldo forever.

This is refreshing in talk radio today--particularly on a right leaning station--it's a breath of fresh air to be cherished.

The radio should be free for everyone--a free distribution of news and information--opinion is fine, but not just one opinion.

Rita Cosby hits the nail on the head, too, and she would be the perfect fill-in until the return of Geraldo.

Where in the world is Geraldo Rivera--has he been taken hostage by Donald Trump.....is Geraldo fixing Donald's hair.

Will we ever know the answer to these questions........

Here's wishing the best to Geraldo and Rita---and missing the interesting insights from Bernie Kerik on Monday's with the Commish.

My question to Bernie--what is your take on police traffic officers wearing cameras in light of recent accusations of officers taking advantage of ladies on traffic stops---this was suggested in San Diego after three incidents.  The department was also taken over by Zimmerman--the first female chief of police in San Diego.

What do you think Bernie?

Reverend Al Sharpton Wired for Sound by Rudy Giuliani

Geraldo Radio, Noam Radio, Rudy Radio, Bernie Radio!

Seriously, Geraldo Rivera runs an informative radio show....even when he is not there.

Today we had Noam, in for Geraldo--busy on his secret mission.......

Check out the video, Noam is not only pleasant on the radio but he is cute, too.

Noam went on today with Rudy Giuliani talking about the new mayor of New York De Blasio.......Rudy gave his take on things....how Mr. De Blasio is doing so far and how his style will pan out over a period of time.

Rudy thinks he is doing a pretty good job but would suggest he clean up his act about being late for the press conference.

Like Bernie Kerik--Mondays's with the Commish--Rudy is a frequent guest of the show but the cool thing is--agree or disagree--Rudy had the gift of explaining things in a conversational way.  He explained the mayor can get blamed for everything regardless of his ability to control it or not.  Rudy was blamed for record snow shortly after he was in office.

The New Yorkers take it personally when it comes to shoveling snow.

There are still complaints from certain areas of town where it was thought the snow was not removed in a fast enough way to please the residents of those streets.


As far as how he has done in office so far.......good and bad...he does not deserve a grade so far as it is just too soon.  Rudy said he has a completely  different philosophy regarding city government and business so he is a bit one-sided and maybe not the best one to give an opinion.  Having said that he gave us a lot of info about the new mayor--explaining how things work--I love that.


Talking about Al Sharpton possibly wearing a wire.......referring all inquires to the justice dept he said he was the United States attorney at the time and he cannot really talk about the claim of him wearing a wire, as reported recently in the news.  It happened in Rudy's district.

Rudy explained he had dealt with very tough criminals at the time and he was bound by the rules of the law....there was a contract out for his life for 800,000 dollars.  This was in 1984.

He is not saying he already knew about it but he did say he was very active in justice at the time.

Noam Laden suggested Rudy Giuliani and Al Sharpton seemed as if they hated each other at the time but the question remains is Giuliani the one who wired AL Sharpton.......it sure seems like it according to Noam.

Good scoop, Noam, the caller said, Geraldo is going to be proud of you.

Geraldo is the friend of Reverend Al and has defended him many times as this blog has mentioned on many occasions the hatred rant of Bill O'Reilly against Al Sharpton.  It does not take long to listen to his show, Politics Nation, to find spiritual inspiration in his words.
